How to know if mediation is right for you

Mediation can be one of the best steps you take during divorce proceedings. It allows both spouses to meet with a neutral third party and discuss a peaceful resolution to allocating assets. In Indiana, some couples even qualify for free or low-cost mediation services. 

Virtually all couples want to save money during a divorce, and mediation can certainly assist with that. However, similar to any other service, it will not be right for everyone. As you and your spouse discuss the possibility of mediation, there is only one question you really need to ask yourselves.

Do you trust your spouse?

Mediation will only be successful if there is a baseline level of trust. You need to be confident your partner will come to the table honest and open. You should be confident your spouse will tell you every last detail of how much debt he or she has accumulated and how much money he or she owns. If there is any doubt in your mind your spouse has not been truthful, then your best option involves hiring an attorney, who has the necessary resources to determine what a person’s true assets are. 

People assume mediation will not work if the reason for the divorce was adultery. However, it is possible to see some success with mediation in this instance as long as both parties are able to move on from the circumstances surrounding the reason for the divorce and focus on how everyone can come out of this situation all right. 

You may want to go through mediation, but your spouse is reluctant. It is important to be patient and understanding. The spouse may have received advice from friends or family members to not utilize mediation, but as long as you explain your position and how mediation can help your situation, then your spouse may become more open to the idea. Mediation will only work if all parties involved actively want to be there. If your spouse provides too much pushback, then it may be time to proceed with divorce
